1. Description of Service

BuildCalc Pro is a construction platform combining:

• Calculator suite: 60+ pro-grade calculators across roofing, painting, flooring, structure & masonry for estimating material quantities and costs, with industry-standard waste factors and unit conversions.
• Contractor marketplace: homeowners post jobs and contractors respond with quotes, with bilateral verified reviews tied to completed jobs.
• Contractor profile system: portfolio photos, service categories, and ZIP-code-based service areas.
• Project management: PDF estimate export and material breakdown.
• Live material price comparison at major U.S. suppliers (Home Depot, Lowe's, Menards, Floor & Decor, Ferguson, 84 Lumber, ABC Supply, and others depending on plan).
• In-app messaging, notifications, and review prompts.

The App is available as a web app and as native iOS and Android apps. Calculators work offline; marketplace features require an internet connection.

2. User Accounts

You may use the App as a guest with limited features. To access the full feature set, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3. Subscription Plans

BuildCalc Pro offers the following subscription tiers:

• Free Plan: Limited to 16 calculators, 1 project, and basic PDF export.
• Pro Plan ($9.99/month or $99.99/year): Unlocks 45+ calculators, unlimited projects, real-time pricing, and contractor estimate PDFs.
• Business Plan ($29.99/month or $299.99/year): Includes all Pro features plus company branding on PDFs, client database, bulk export, and analytics dashboard.

4. Billing & Cancellation

Subscriptions are billed through the Apple App Store, Google Play Store, or Stripe (for web) depending on your platform. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.

You may cancel your subscription at any time through:

• iOS: Settings > Apple ID > Subscriptions
• Android: Google Play Store > Subscriptions
• Web: Profile > Manage Subscription

Upon cancellation, you retain access to paid features until the end of your current billing period. No refunds are provided for partial periods.

5. Accuracy Disclaimer

IMPORTANT: All calculations, material quantities, and cost estimates provided by BuildCalc Pro are approximations based on industry-standard coefficients and publicly available pricing data. They are intended as planning guides only.

BuildCalc Pro does NOT guarantee the accuracy of any calculation or estimate. Material requirements may vary based on site conditions, waste factors, local building codes, installation methods, and other variables. Always verify quantities with a qualified professional before purchasing materials or submitting bids.

Prices displayed are estimates and may not reflect current retail prices. Always confirm pricing with your supplier before making purchasing decisions.

6. Intellectual Property

All content, code, designs, logos, and data in BuildCalc Pro are the property of BuildCalc Pro and are protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any portion of the App without written permission.

7. User-Generated Content

Any data you enter (projects, client information, company profiles) remains your property. We do not claim ownership of your data. By using cloud sync features, you grant us a limited license to store and transmit your data solely for the purpose of providing the service.

8. Prohibited Uses

You agree not to:

• Use the App for any illegal purpose
• Attempt to gain unauthorized access to the App or its systems
• Share your account credentials with others
• Use automated scripts to access the App
• Resell or redistribute the App or its data
• Use the App to submit fraudulent bids or estimates

9. Limitation of Liability

To the maximum extent permitted by law, BuildCalc Pro and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to losses from incorrect calculations, material over- or under-ordering, or reliance on pricing data.

Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless BuildCalc Pro and its developers from any claims, damages, or expenses arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

11. Modifications

We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms. We will notify users of material changes through the App or email.

12. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the App ceases immediately. Sections regarding liability, indemnification, and intellectual property survive termination.

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.

14. Marketplace and Third-Party Contractors

BuildCalc Pro provides a marketplace platform that connects homeowners with independent contractors. BuildCalc Pro does not employ, endorse, or guarantee any contractor listed on the platform.

Users are solely responsible for:

• Verifying contractor licenses, certifications, insurance, and qualifications
• Conducting background checks and reference verification
• Evaluating the quality and suitability of contractors for their projects
• Negotiating terms, prices, and contracts directly with contractors

BuildCalc Pro makes no representations or warranties regarding the accuracy of contractor profiles, license information, reviews, or ratings. All contractor-provided information is self-reported and unverified by BuildCalc Pro unless explicitly marked as verified.
